21 NCAC 46 .1603 WHEN A NEW PERMIT IS REQUIRED

Rule .1603 states that a new permit is required for a new location, change to a different or successor business entity, or a change of majority control.

CHANGE OF ADDRESS OR PERCENTAGE OF OWNERSHIP CHANGE WITHIN AN EXISTING GROUP OF STAKEHOLDERS (“RE-REGISTRATION”):  Re-registration is required when there is a change of location or a percentage of ownership change within an existing group of stakeholders.  Re-registration requires submission of an application, fee, and approval by the Board.

Also required for address changes are:

FOR IN-STATE PHARMACIES: effective date, pictures of the new facility, and proof of occupancy in the new location.

FOR OUT-OF-STATE PHARMACIES: effective date, pictures of the new facility, a current operational inspection report, and copy of the license.

For percentage of ownership change within an existing group of stakeholders, an explanation of the change is required along with items 3 and 8 of the application. The permit number remains the same and a new registration date will be given.  Send required materials in prior to the effective date of the change (at least six weeks) so the application can be reviewed and processed.

FOR OUT-OF-STATE PHARMACIES: a current operational inspection report, and a copy of the license.
